Astrofest Astrophotography Competition and Exhibition Terms & Conditions of Entry 2024
General
1. The promoter of the Astrofest Astrophotography Competition (“Competition”) is the University of Western Australia, as Centre Agent for ICRAR (ABN 37 882 817 280) of 35 Stirling Highway, Crawley, Western Australia 6009 (“ICRAR‟).
2. Details on eligibility, how to enter and the prizes for the Competition are set out in these terms and conditions of entry (“Terms and Conditions”). By entering into this Competition, entrants are deemed to have accepted these Terms and Conditions.

Who can enter
4. Subject to clause 5, any person Western Australia-wide of any age, who has fulfilled the requirements set out in these Terms and Conditions is eligible to enter the Competition. Entrants under the age of 15 must provide parental consent to enter.
5. Employees of ICRAR or its associated agencies and companies, and their immediate family members are eligible to enter this Competition.
6. ICRAR or its contractor or agent may, in their absolute discretion, disqualify an entrant for any reason including breaching these terms and conditions, or acceptable or reasonable standards of safety, conduct and respect.

How to enter
7. Eligible persons may enter the Competition by submitting images or video in a digital format as described in clause 7(b) via the upload link accessible from the Astronomy WA Astrofest website: https://www.astronomywa.net.au/astrofest-astrophotography-competition-enter.html
a. Entrants must be the owner of their photo or video (“Work”), having authored the Work and currently hold copyright ownership for the Work.
b. Each entry must be submitted for one of the following awards |

c. Nightscape entries applicable to the Best Astrotourism WA Award, which is an award within this same competition, must be stated as such; and include the name of the Astrotourism WA Shire/Local Government locality in the submission; and will feature terrestrial elements located in the Astrotourism WA Local Government locality. For the Astrotourism WA Award the eligible Local Government localities include those towns registered with Astrotourism WA, listed on the AstrotourismWA site at: https://astrotourismwa.com.au/towns/.
d. Under-15 entries applicable to the Best Under-15 Photo award, which is an award within this same competition, must be stated as such. e. For entries into the SPIRIT Image of the Year 2024, please refer to the Terms & Conditions for this award, found at https://www.icrar.org/outreach-education/spirit/spirit-image-of-the-year/. Note, in instances where these terms and conditions differ from those outlined in the SPIRIT Image of the Year 2024, those terms and conditions supersede those listed here. f. In the case of Works with multiple Entrants, the instigator of the Work will be the principal Entrant and the one who “owns” the Work. The principal Entrant must have performed the majority of the work to produce the image. All Entrants must be identified and named on the entry form along with their contributions to the production image. In the event of the Work receiving an award, the principal Entrant will be awarded the prize associated with that award (if any). g. Still images must be submitted as JPG. h. Video sequences must be submitted as MOV, MPG, MP4 or AVI, and be no longer than 2 minutes in length. i. No entry fees are payable. |
8. ICRAR has the discretion to deem incomprehensible, illegible, non-compliant and incomplete entries invalid.
Number of entries permitted
9. Entrants may submit up to 5 entries to the competition in any given year.
10. If an entrant wishes to submit the same Work for more than one category they may submit the Work once for each desired category. Each of those submissions to separate categories uses one of their 5 allowed entries per person.

Prizes on offer
11. The prizes are:
a. Best Deep Sky Photo: Trophy and a Stargazers Club WA Gold Galaxy Membership, valued at $330.
b. Best Solar Photo: Trophy and a telescope provided by Skywatcher, 70 Refractor SolarQuest on HelioFind Mount valued at $1,149.99. c. Best Lunar Photo: Trophy and a voucher for any product at Kudos Cameras, valued at $435. d. Best Planetary Photo: Trophy and a gift voucher worth $400 provided by Astrofest. e. Best Nightscape Photo: Trophy and a voucher for an Exclusive Night Sky Tour for 10 people at Perth Observatory, valued at $500, provided by Perth Observatory. f. Best Timelapse video: Trophy and a Camera Electronic gift voucher valued at $300 provided by Camera Electronic. g. Best Aurora Australis Photo: Trophy and a Sony Alpha 7 IV Full-Frame and a SEL14F18GM G Master Prime Lens, valued at $4,853 provided by Sony Australia. h. Best Under-15 Photo: Trophy and a voucher for a one-on-one astrophotography session with Roger Groom of Astro Photography Australia, for one participant and one tag-along non-photographer, valued at $300. i. Best Night Sky Friendly Lighting Photo: Trophy, an Australasian Dark Sky Alliance membership, and a voucher valued at $500, provided by ADSA. j. Best Astrotourism Towns Nightscape Photo: Trophy and two nights’ accommodation at the Gascoyne Junction Pub and Tourist Park in a 1 Bedroom Self Contained unit plus a $75 gift voucher to spend at the Gascoyne Junction Pub and Tourist Park restaurant. It will also include one night accommodation at the Mount Augustus Tourist Park in a Self Contained Unit plus a $75 gift voucher to spend at the Mount View Dining Room. Prize provided by the Shire of Upper Gascoyne, valued at $628. k. People’s Choice: Trophy and a gift voucher worth $350 provided by Astrofest. |
12. The prize is subject to the following rules:
a. the prize winning entries shall be selected by the judging panel at its absolute discretion (subject to clause 15);
b. the prize must be taken as stated at clause 11 and is non-transferable, non-exchangeable and not redeemable for cash; c. if the specified prize becomes unavailable for any reason, ICRAR may, but is under no obligation to, substitute a prize of like or equal value; d. any tax payable as a result of the prize being awarded or received will be the prize winner's responsibility; e. ICRAR takes no responsibility for the loss of the prize or the inability of the prize winner to use the prize due to incorrect or imprecise delivery details provided by the prize winner, or otherwise; and f. ICRAR makes no representations or warranties as to the quality, suitability, or merchantability of the Prize. |
13. The winner acknowledges and agrees that no other payment, cost, fee or prize is payable to the winner by ICRAR other than as expressly stated in clauses 11 and 12 above.
Open, close and draw and publish date
14. The competition commences on 20th July 2024 at 9:00am AWST and closes on 18th August 2024 at 11:59pm AWST (“Promotional Period‟). Entries must be received by ICRAR during the Promotional Period to be valid. Entries received after this time will not be included in the Competition and ICRAR accepts no responsibility for late, lost, misdirected, incorrect or invalid entries.
15. The prize winner will be determined by the Astrophotography Exhibition Curator (“Curator”), contracted by ICRAR.

a. Entries are judged by a panel of judges appointed by the Curator.
b. Judging decisions are final and no discussion will be entered in to. c. Judges and the Curator reserve the right to reject any entry that, in the opinion of the judges or Curator, does not meet the conditions of entry or is unsuitable for public display. The decision of the Judges and Curator will be final. |
16. The prize selection will take place by 9th November 2024
17. The winners will be notified at the Perth Astrofest event on 9th November 2024, at Curtin Stadium on Kent Street, Bentley, on the main stage. Applicants will be notified of the exact schedule closer to the date of the event. Winners not present will be notified via email or phone no more than 5 days following Perth Astrofest.
18. ICRAR will post the prize to the winner. ICRAR will not be responsible for the prize once it is posted.

Publicity of Competition
19. It is a condition of entry in the Competition that ICRAR has the right to publish the name, image, voice, photograph or video of entrants (“Materials”) for any matter incidental to the Competition or the promotion or marketing of Astrofest, Astronomy WA or the Astrofest Astrophotography Exhibition including without limiting on websites or other electronic means.
20. It is a condition of entry in the Competition that ICRAR has the right to use entries at Perth Astrofests (from 2021 and at future Perth Astrofests if required) as part of the Astrophotography Exhibition, online and in print in promotion of the exhibition and Astrofest, and in catalogues and other materials for the exhibition. The Entrant grants a non-exclusive, non-transferrable license for the organisers of the exhibition to reproduce their submitted photographs for purposes relating directly to the Astrofest Astrophotography Competition and Exhibition, Astrofest or Astronomy WA.
21. All entries remain the intellectual property of the entrant. Any physical prints of the entry are the property of ICRAR and will not be returned to the entrant.

23. Entrants can choose how they would prefer their submitted Works to be used as part of the exhibition through an opt-in process. Once opted in, entrants may opt out at any time in the future by contacting the Curator. Once opted out images will no longer be displayed. Opt-ins will be offered during submission in the following areas:

a. Images being displayed at associated Astrofest events (such as, but not limited to, Mount Magnet Astrofest, Pingelly Astrofest etc) including in promotion of the same.
b. Images being included in associated Astrofest Astrophotography standalone limited period exhibitions at various locations (such as, but not limited to, galleries, museum exhibition spaces and tourism information and exhibition spaces within Western Australia including in promotion of the same. c. If a winning image in any category, being on display at BinoCentral for an extended period (approximately 12 months, until the next winners are displayed). d. Being displayed for extended periods at Curtin University and The University of Western Australia in various buildings/offices (Such as the Brodie-Hall Building and the Ken and Julie Michael Building) |
24. Any use of the entries separate to Astrofest or Astronomy WA will only be allowed with entrant’s written permission.
25. Except for any liability that cannot be excluded by law, ICRAR (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, liabilities arising from or in connection with:

Except for any liability that cannot be excluded by law, ICRAR (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, liabilities arising from or in connection with:
a. any technical difficulties or equipment malfunction (whether or not under ICRAR’s control);
b. any theft, unauthorized access or third party interference; c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by ICRAR) due to any reason beyond the reasonable control of ICRAR; d. any variation in prize value to that stated in these Terms and Conditions; e. any tax liability incurred by a winner or entrant; f. redemption of the prize; and g. participation in the Competition |
26. Entrants warrant that their Entries are in no way illegal, unlawful, fraudulent, in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent or abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, unsuitable for viewing by children aged under 18, or otherwise unsuitable for publication.
Cancellation
27. ICRAR reserves the right to suspend, cancel or otherwise close the competition earlier than is stated in these terms and conditions for safety, security, technical failures, weather conditions or any other causes which affect the proper administration, fairness or security of the Competition.
